Mr. Daman Nath Dhungana, Senior Advocate - OF Counsel

Mr. Dhungana is one of the most senior advocates in Nepal. He is a former Speaker of the House of Representative as well as a Member of Drafting Committee of the 1990 Constitution of Nepal. Over the last 10 years, he has facilitated the peace process of Nepal. As an Of Counsel of TLH, he guides young lawyer when required and provides appointments for TLH’s clients that seek his expertise on matters of constitutional law, investment facilitation and arbitration.

   

Prof. Laxman Kumar Upadhyay - OF Counsel

Mr. Upadhyay is the most senior Professor of Law in Nepal and former Dean of Faculty of Law, Tribhuvan University. He is an expert of Public and Private International Law. Over the years he has advised multitude of National and International institutions and private companies on various legal matters. As an OF Counsel of TLH, he guides young attorneys and provides his services as and when required.

   

Professor Surya Subedi OBE, QC (Hon) - Of Counsel
Professor Subedi is a Barrister in United Kingdom and member of Three Stones, Commercial Chancery Barristers. As an Of Counsel of Transnational Law House, he avails his services for the business and investment in Nepal as and when requires.
Surya is a lawyer whose legal competence spans a number of areas of international law, including public international law, the law of the sea, international investment law, international trade law, international watercourses law, land and maritime boundary disputes, international human rights law and the Indian and Nepalese legal systems.
He served as the United Nations Special Rapporteur for human rights in Cambodia between 2009 and 2015.
Surya was appointed a QC (Hon) in the UK in 2017 in recognition of his contribution to international law and human rights and made an OBE for services to international law and to Britain-Nepal relations in 2004.
His late Majesty King Birendra of Nepal awarded him with a high-level State honour, Suprabal Gorkha Daxinbahu, for services to international law and to the nation in 1998.
Surya has advised a number of governments and public utility companies on international legal matters and appeared before higher courts both in England and in Nepal. He also has provided expert opinion in cases before English courts on matters relating to adoption, divorce, custody of children, inheritance, and crime in both Indian and Nepalese Law. Prior to joining the Bar of England, he was a consultant on international legal matters to Mishcon de Reya Solicitors, London.
Surya’s expertise in these areas of law combines teaching, research, practising law, and high level positions with responsibilities for policy formulation and advice. He has published extensively in international law.  With a doctoral degree in law from the University of Oxford and an LLM with Distinction in international law from the University of Hull, Surya has been Professor of International Law at the University of Leeds since 2004.
Surya also has taught international economic law, international investment law, and the law of the sea on the intercollegiate International LLM Programme of the University of London and has been to teach on the international human rights law programme of the University of Oxford.
Surya has been designated to serve on the Panels of Arbitrators and of Conciliators of the International Centre for Settlement of Investment Disputes (ICSID) and on the Panels of the Dispute Settlement Body of the World Trade Organization (WTO). He was elected to the Institut de Droit International in 2011 and has served as a member of its Commission on legal aspects of international investment arbitration.
He has been an expert member of the Task Force on Investment Policy of the World Economic Forum in Davos and International Centre for the International Centre for Trade and Sustainable Development in Geneva since 2015. Dr. Rudra Sharma - Managing Partner

Dr. Rudra Sharma is the Managing Partner of TLH and co-ordinates a team of young attorneys and senior attorneys. Currently, Dr. Sharma also teaches LL.M students subjects such as privatization, foreign investment and technology transfer, World Trade Organization, Intellectual Property, national and international arbitration. Mr. Sharma also supervises researches carried out by LL.M students on commercial laws. He has a sound corporate law background. He worked as a legal consultant for five years for the Federation of Nepalese Chambers of Commerce and Industry ( FNCCI); represented several legal claims from the private sectors of Nepal; established Brand ( intellectual property) cell and commercial mediation center in the FNCCI. He worked for FNCCI to draft core corporate laws of Nepal such as the Company Act, Competition Act, Intellectual Property Law, Government Procurement Law and Custom Act. Dr. Sharma’s duel advance degrees, LLM in Commercial Law from Nepal and another LL.M from United States of America in Transnational Business Practice, and his 13 years practice of law has made him a seasoned corporate lawyers in Nepal. He is typically known for his expertise on international contract formation, contract negotiation and implementation of contract with respect to projects.

 

Dr. Sharma advises national and international banking institutions and he has advised transactions of multinational companies like Group 4 Falk, ICRAFT, HUAWEI, OPTICHINA and ALVARION.  He has also provided advise in mega projects such as the Birjung-Kathmandu Railway of Benchmark Pvt. Ltd., Telecommunication Company, NCELL (erstwhile Mero Mobile),  Rasuwa Bhotekoshi Hydropower Project (100 MW), Middle Bhotekoshi Hydropower Project (102MW), Mistrikhola Hydropower Project (42 MW), and Energy Council  of Confederation of Nepalese Industries (CNI). Mr. Sharma has also worked as a consultant for UNDP project to frame Intellectual Property for Nepal. He has also worked in a renowned law firm in California called Rothschild & Sands and interned in another law firm in California called Hector Davila. Mr. Sharma is also a frequent writer on corporate, constitutional and transnational legal issues; he has national and international publications including in the America Chronicle  (http://www.americanchronicle.com/authors/view/3932)  and speaks frequently in media on these issues. His writings on World Trade Organization (WTO)  played a significant role in Nepal’s membership of the WTO in 2004.

   

Mr. Sanjiv Ban

Sanjiv is an assistant to the Managing Partner of THL. He assists the Managing Partner for the core functions of THL. He has been assisting the senior attorneys and partners of THL in the sector of corporate litigation, drafting of contracts, legal opinions as well as translation of various legal documents. Sanjiv also assists the Managing Partner of TLH for registration of trademarks in over 180 countries all over the world. He is also involved to assist TLH for the activities related to protection of copyright in all 164 plus World Trade Organization (WTO) member countries. Sanjiv's involvement in the TLH activities about trademark and copyright is leading him towards specialization in intellectual property.

   
   
  Mr. Janak Regmi - Associate

Mr. Regmi is specialized in trademark, intellectual property and taxation. He has accomplished comprehensive research on trademark. He assists TLH on matters of tax compliance and trademark registration; he keeps the firm updated on trademark related issues. Mr. Regmi has also assisted the Managing Partner of TLH for the project of Confederation of Nepalese Industries (CNI) on "An In-Depth Assessment of Current Constraints Relating to Trademark in Nepal".
   

Mr. Nishesh Dhungana - Paralegal Associate

Mr. Dhungana is a Lecturer of International Relations and Diplomacy in Kathmandu University and also teaches Political Science in Kathmandu School of Law. Mr. Dhungana has worked as a consultant to the Election Commission of Nepal and USAID, Nepal. Mr. Dhungana holds M.A. in Political Science and International Relations from Jawaharlal Nehru University, India and B.A. in Political Science from Minnesota State University, Marshall, USA. He is currently completing his LLB and works in the firm as a paralegal associate. His experience and education in international relations is an asset when advising clients in terms of investment facilitation across the border.

   

Samjhana Sharma - Manager

Ms. Sharma holds a BBS and has sound interpersonal skills to communicate and deal with our clients. She is fluent in Nepali, English, Hindi and has a basic knowledge of Spanish. She can identify the needs our transnational clients as she has widely travelled to India, Japan and United States of America.

   

Suraj Bhattari - Outreach Manager

Mr. Bhattarai manages outreach activities of TLH such as following up on applications and issues in government departments like Department of Industries and Office of the Company Registrar.  His service is really important for TLH with respect to follow up and coordination of trademark applications filed by TLH representing product and services from all over the world. Mr. Bhattarai has worked in the Italian Embassy of Kathmandu as well as in several national and international organizations. Additionally, Mr. Bhattarai is also a renowned social worker in Kathmandu Municipality. Mr. Bhattari has assisted Mr. Damannath Dhungana for the last 20 years. He is responsible for arranging Mr. Dhungana’s appointments and assists Mr. Dhungana with clerical matters.

   

Mr. Padam Bahadur Khadka - Administration Officer

Mr. Khadka is responsible for carrying out daily operation of the firm. He has worked as an assistant for the Minister of Science and Technology. His work experience at National Information Technology Center helps TLH to make our office tech savvy. He has also assisted the Managing Partner of TLH for the project of Confederation of Nepalese Industries (CNI) on "An In-Depth Assessment of Current Constraints Relating to Trademark in Nepal".
